Abstract
El alto porcentaje de empleo informal en el Perú es tema de trascendencia social, especialmente para el Derecho Laboral. Esta investigación, enfoca su estudio en la ciudad de Lima Metropolitana y tiene el objetivo de: analizar como la Covid-19 ha influenciado en la dación de eficaces políticas públicas para el empleo informal en la ciudad de Lima Metropolitana durante los meses de marzo, abril y mayo del año 2020; desde ese año, a causa de la emergencia sanitaria y la informalidad por ser un sector vulnerable, ha contribuido al incremento de los casos de contagio de la Covid-19, y al crecimiento del trabajo informal
acentuando las complicaciones en la economía. La investigación es cualitativa, porque, se enfatizan en la identificación de particularidades que no son observados por la estadística; es decir, se centra en
la búsqueda de las causas de los fenómenos hallados en una realidad y centrándose en estudios de análisis e interpretación de los mismos. Se evidenció la falta de políticas públicas eficaces en relación con el empleo informal; revisándose las normas dictadas en los primeros meses de pandemia
en las que los trabajadores informales se vieron desprotegidos. Se ha contrastado la normativa, llegando a determinar que sólo existieron reglas para quienes pertenecen al empleo formal. Finalmente, se formula una propuesta legislativa que permitiría pasar a la formalidad y ofrecer mejores perspectivas de futuro.
The high percentage of informal employment in Peru is an issue of social importance, especially for Labor Law. This research focuses its study on the city of Metropolitan Lima and aims to analyze how Covid-19 has influenced the implementation of effective public policies for informal employment in the city of Metropolitan Lima during the months of March, April and May 2020; since that year, due to the health emergency and informality due to being a vulnerable sector, it has contributed to the increase in cases of Covid-19 contagion, and to the growth of informal work, accentuating the complications in the economy. The research is qualitative, because it emphasizes the identification of particularities that are not observed by statistics; In other words, it focuses on the search for the causes of the phenomena found in a reality and focuses on studies of analysis and interpretation of them. The lack of effective public policies in relation to informal employment was evident; reviewing the rules issued in the first months of the pandemic in which informal workers were left unprotected. The regulations have been contrasted, and it has been determined that there were only rules for those who belong to formal employment. Finally, a legislative proposal is formulated that would make it possible to move to formality and offer better prospects for the future.
