Abstract
La investigación analiza los procesos de filiación, tramitados en los Juzgados de
Paz Letrados, donde los Jueces actúan como meros aplicadores de la Ley de
Filiación Extramatrimonial, declarando la paternidad de los Niños, Niñas y
Adolescentes, sin la realización de la prueba del ADN, cuando no hay oposición
del supuesto padre. El interés superior de un niño, se evalúa como consideración
primordial y obligación del Estado de asegurar la protección y preservación de la
información sobre el origen genético de los Niños, Niñas y Adolescentes.
Para el desarrollo de la investigación se ha observado la Jurisprudencia nacional,
que fue seleccionada tomando en cuenta los fundamentos de análisis de
sentencias emitidas en los procesos filiatorios, que -en la mayoría- concluyen
que la Ley de Filiación Extramatrimonial no garantiza la identidad genética de los
Niños, Niñas y Adolescentes que son sometidos en un proceso filiatorio.
The investigation analyzes the filiation processes, processed in the Law Courts of the Peace, where the Judges act as mere applicants of the Extrajudicial Affiliation Law declaring the paternity of the Boys, Girls and Adolescents, without performing the DNA test, when there is no opposition from the alleged father. The best interest of a child is evaluated as a primary consideration and obligation of the State to ensure the protection and preservation of information on the genetic origin of Boys, Girls and Adolescents. For the development of the investigation, the national jurisprudence has been observed, which was selected taking into account the bases of analysis of sentences issued in filiation processes, which -in the majority- conclude that the Extrajudicial Affiliation Law does not guarantee the genetic identity of Boys, Girls and Adolescents who are subjected to filiation proceedings.
