Abstract
Esta tesis pretende crear una regulación especial de las transacciones extrajudiciales en conflictos socio ambientales, por la diferencia entre las partes, en donde la parte afectada, se encuentra en desventaja frente a la otra (porque esta última posee: la información del elemento generador del daño, la información de los planes de contingencia y emergencia en caso de accedentes y poder económico) y que los daños a transigir son respecto a la vida, salud y medio ambiente. Asimismo, por medio de la tesis se evidencia que para suscribir las transacciones extrajudiciales en conflictos socio ambientales se debe analizar los efectos que puedan causar en la vida, salud y medio ambiente de las poblaciones expuestas a la contaminación, ello con la finalidad de que estos acuerdos puedan ser calificadas como justos. Por ello, este trabajo de investigación considera necesario regular un procedimiento especial para suscribir transacciones extrajudiciales en conflictos socio ambientales con el objetivo de reducir la asimetría existente entre las partes y buscar que dichas transacciones reparan el daño causado, y velar por la protección de los derechos fundamentales de la parte afectada.
This thesis aims to create a special regulation to the extrajudicial transactions in socio-environmental conflicts, by the difference between the parties, in which the affected part is at a disadvantage against the other (because the latter has: information generator of the damage the information and emergency contingency plans in case of accidents and economic power) and that damage to compromise are about life, health and environment. Also, through the evidence thesis to subscribe extrajudicial transactions in socio-environmental conflicts should analyze the effects that can cause in life, health and environment of populations exposed to pollution, this is intended that these agreements can be classified as fair. Therefore, this research considers necessary to regulate a special procedure to subscribe extrajudicial transactions in socio-environmental conflicts with the goal of reducing the asymmetry between the parties and find that such transactions repair the damage, and to ensure the protection of the rights fundamental of the affected part.
