Resumen
En nuestro país muchas familias se conforman por personas que, no teniendo impedimento de contraer matrimonio, decidieron no casarse. Sus derechos respecto a la protección a la familia no deberían ser condicionados al matrimonio, ello atenta contra el derecho a lo no discriminación, más aun teniendo en cuenta que los beneficiarios del patrimonio familiar en su mayoría son hijos menores, ascendentes en estado de necesidad y hermanos menores o incapaces. La presente tesis tiene el objetivo de demostrar la necesidad de implementar la institución jurídica del patrimonio familiar en las uniones de hecho en el Perú, el método utilizado fue el analítico y comparativo. Esta investigación correspondió a un diseño con enfoque cualitativo a un nivel descriptivo no experimental. Las familias conformadas por uniones de hecho son merecedoras de protección por parte del parte del Estado tal como las matrimoniales; haciendo un análisis de la normativa nacional y la legislación comparada en los países de Argentina, Bolivia, Ecuador y México observamos la existencia de un vacío legal y llegamos a la conclusión que esta situación vulnera el derecho a la igualdad y al principio de no discriminación, se propone un Anteproyecto de ley que permita modificar el artículo 493 del Código Civil y añadir un supuesto de hecho que les permitirá obtener sus derechos, de esta manera estaremos acorde con los tratados internacionales y los lineamientos para la protección de las familias, igualdad y autonomía de la voluntad.
In our country many families are made up of people who, not being prevented from getting married, decided not to get married. Their rights with respect to the protection of the family should not be conditioned to marriage, as this goes against the right to non-discrimination, especially considering that the beneficiaries of the family patrimony are mostly minor children, ascendants in a state of need and minor or incapable siblings. The objective of this thesis is to demonstrate the need to implement the legal institution of family patrimony in de facto unions in Peru, the method used was analytical and comparative. This research corresponded to a qualitative design with a non-experimental descriptive approach. The families formed by de facto unions are deserving of protection by the State just like married couples. By analyzing national regulations and comparative legislation in Argentina, Bolivia, Ecuador and Mexico, we observed the existence of a legal vacuum and concluded that this situation violates the right to equality and the principle of non-discrimination, We propose a draft bill to amend Article 493 of the Civil Code and add a factual assumption that will allow them to obtain their rights, in this way we will be in accordance with international treaties and guidelines for the protection of families, equality and autonomy of will.
