Abstract
Esta investigación tiene como propósito determinar si la falta de regulación respecto a los derechos y deberes del padre afín afecta al Interés superior del niño. De ese modo, se ha planteado la posibilidad de señalar cuáles son estos derechos y deberes que correspondería establecerse en nuestra legislación, así como la viabilidad de delegar al padre afín atribuciones correspondientes a la responsabilidad parental, con la finalidad de ampliar la protección a los integrantes de la familia reconstituida y poder garantizar el desarrollo integral de los niños, niñas y adolescentes que forman parte de esta estructura familiar.
Asimismo, se ha buscado determinar cuáles serían los derechos subsistentes entre padres e hijos afines, luego del quiebre de la relación con la que surgió la
familia reconstituida.
En ese sentido se ha tenido en consideración los cambios que se han producido respecto a la concepción de familias a la luz de las transformaciones sociales,
analizando cuatro sentencias del Tribunal Constitucional Peruano en las que se ha desarrollado la temática de la familia reconstituida, así como la relación entre padres afines e hijos afines.
The purpose of this investigation is to determine if Child´s Best Interest is affected by de absence of regulation about the rights and duties of the related parent. Inthe same way, the possibility has been raised of indicating which are these rights and duties that would correspond to be established in our legislation, as well as the viability of delegating to the related parent attributions corresponding to parental responsibility, in order to extend the protection to the members of the blended family and to be able to guarantee the integral development of the children and adolescents that are part of this family structure. Likewise, it has been intended to determine what would be the subsisting rights between parents and related children, after the breakdown of the relationship. In this sense, the changes that have occurred regarding the conception of families in light of social transformations have been taken into consideration, analyzing four judgments of the Peruvian Constitutional Court in which the theme of the blended family has been developed, as well as the relationship related parents and related children.
