Abstract
La gestación por sustitución es una técnica de reproducción asistida que
presenta una serie de controversias jurídicas en la determinación de la
maternidad ante la ausencia de su regulación en el ordenamiento jurídico
peruano. Por ello, la presente investigación tuvo como objetivo determinar, si en
los casos de gestación por sustitución, los jueces han respetado el derecho a la
identidad e interés superior del niño. Para dicho propósito se utilizó el enfoque
cualitativo y tipo de investigación básica; se recolectaron los datos a través de la
técnica del análisis jurisprudencial tres sentencias emitidas de la Sala Civil
Permanente de la Corte Suprema de Justicia de la República y una sentencia de la
Sala Civil Permanente de la Corte Superior de Justicia de Lima, mediante las
cuales se resolvió la validez de los acuerdos de gestación por sustitución, así
como la determinación de la maternidad entre la madre genética y/o biológica y
la madre afectiva. En ese sentido, los resultados obtenidos fueron discutidos
llegándose obtener las conclusiones y recomendaciones.
Surrogacy gestation is an assisted reproduction technique that presents a series of legal controversies in the determination of maternity in the absence of its regulation in the Peruvian legal system. Therefore, the present investigation aimed to determine if, in cases of gestation by substitution, the judges have respected the right to identity and the best interests of the child. For this purpose, the qualitative approach and type of basic research were used; The data was collected through the technique of jurisprudential analysis, three sentences issued by the Permanent Civil Chamber of the Supreme Court of Justice of the Republic and a sentence of the Permanent Civil Chamber of the Superior Court of Justice of Lima, through which resolved the validity of surrogacy agreements, as well as the determination of maternity between the genetic and/or biological mother and the affective mother. In this sense, the results obtained were discussed, reaching the conclusions and recommendations.
