La criopreservación de embriones humanos: ¿una forma de vulnerar derechos fundamentales?

Abstract
En el presente trabajo, se analizó el destino de los embriones excedentes de las técnicas de reproducción humana asistida en el Perú, específicamente de la fecundación in vitro, pues con esta técnica, generalmente, se crea una mayor cantidad de embriones de los que serán transferidos en un ciclo reproductivo, haciéndose necesario recurrir a la técnica de criopreservación, a través de la cual se suspende el proceso de división celular de los embriones humanos. El objetivo de esta investigación fue evidenciar si la técnica de criopreservación afectaba el derecho a la vida, la dignidad y/o al normal desarrollo de los embriones humanos, para lo cual se recurrió al método comparativo y descriptivo y a la técnica de análisis documental - estudio y análisis de distintos instrumentos jurídicos nacionales e internacionales, jurisprudencia y doctrina referida a la materia -. Como resultado, se evidenció que la técnica que criopreservación sí afecta el derecho a la vida, la dignidad y al normal desarrollo de los embriones humanos; el embrión concebido in vitro no cuenta con la misma protección jurídica que el embrión concebido de manera natural; y que, en nuestro país, la criopreservación de embriones humanos no se encuentra regulada.
In this paper, the fate of surplus embryos from Assisted Human Reproduction Techniques in Peru was analyzed, specifically in vitro fertilization, because with this technique, generally, a greater number of embryos are created than will be transferred in a reproductive cycle, making it necessary to resort to the cryopreservation technique, through which the process of cell division of human embryos is suspended. The objective of this research was to show whether the cryopreservation technique affected the right to life, dignity and/or normal development of human embryos, for which the comparative and descriptive method and the technique of documentary analysis - study and analysis of different national and international legal instruments, jurisprudence and doctrine referring to the matter - were used. As a result, it was evident that the cryopreservation technique does affect the right to life, dignity and normal development of human embryos; the embryo conceived in vitro does not have the same legal protection as the naturally conceived one; and that, in our country, the cryopreservation of human embryos is not regulated.
