Abstract
La persona desde los inicios de la humanidad se ha interrelacionado, formando así, lo que hoy se conoce como una familia, teniendo como una de sus finalidades, la procreación. Sin embargo, en algunas ocasiones surgen inconvenientes, en las cuales el varón de aquella relación desconoce el fruto de esa unión (hijo). Es allí, donde el derecho protege a la mujer y al niño(a) mediante la figura de la presunción de paternidad; sin embargo, esta protección solo lo ha tipificado para cuando los hechos suceden dentro del matrimonio; pero, qué sucede, con las parejas que han sido declaradas unión de hecho, la norma no lo ha establecido, pero si partimos de la misma normatividad, y se tiene que por la uniones convivenciales se generan obligaciones semejantes al matrimonio, en consecuencia, es factible el poder aplicar esta figura en las “uniones convivenciales” y no vulnerar “el derecho de identidad” de estos niños o niñas.
