Abstract
En el presente trabajo, se analizó la ejecución del Régimen de Visitas en el Perú bajo el contexto de la pandemia que se afrontó desde el año 2020, en el cual se advierte que en muchos casos el derecho a la relación del menor con su progenitor se ha visto afectado. El objetivo de la presente investigación gira en torno a demostrar la importancia de regular el Régimen de Visitas en situaciones de excepción, en aras de salvaguardar el Interés Superior del menor y su derecho a la relación con sus progenitores y su ámbito de desarrollo ha sido la ciudad de Lima. Como participantes del estudio se ha hecho elección de tres especialistas en la materia quienes brindaron su posición sobre la problemática. La metodología utilizada fue un enfoque cualitativo, de tipo no experimental, método documental, comparativo, analítico y exegético. Como resultado se evidenció que, ante la falta de una normativa específica, lineamientos o directivas, los Juzgados de Familia de la Corte Superior de Lima Sur, establecieron en la parte resolutoria de las sentencias, que la ejecución del Régimen de Visitas se llevaría a cabo a través del soporte tecnológico y/o telefónico, con el fin de reforzar los lazos afectivos y preservar el derecho a la relación entre el menor y su progenitor que no ejerce la tenencia.
In the present work, the implementation of the Visitation Regime in Peru was analyzed within the context of the pandemic faced since 2020, in which it is noted that in many cases the child's right to a relationship with their parent has been affected. The objective of this research is to demonstrate the importance of regulating the Visitation Regime in exceptional situations, in order to safeguard the Best Interest of the child and their right to a relationship with their parents. The scope of the study was the city of Lima. Three specialists in the field were selected as study participants, providing their perspectives on the issue. The methodology used was a qualitative approach, non-experimental type, using documentary, comparative, analytical, and exegetical methods. As a result, it was found that, in the absence of specific regulations, guidelines, or directives, the Family Courts of the Superior Court of Lima South established in the operative part of the rulings that the execution of the Visitation Regime would be carried out through technological and/or telephone support, in order to reinforce affective bonds and preserve the right to a relationship between the child and the parent who does not have custody.
